Chief executive of the music organisation Mark Davyd told The Mirror that he has enlisted a legal company to write to the show's producers.

Davyd said: "The first reply from X Factor was basically, 'We don't care'. Maybe I'm naive but I work in an area where I expect people to do the right thing.

"No-one would call a band Nordoff Robbins or Shelter. Now I accept that we are not as big as those organisations but we put on concerts and put out CDs and it's just not appropriate.

"We've started to have to pay out money to protect the integrity of the charity, which I just think is ridiculous."

However, an ITV spokeswoman stated: "The charity in question have trademarked the name 'Rhythmix' for educational purposes only, which is not in conflict with the band or the show."

X Factor contestant failed to cooperate with Ceri Rees

A spokeswoman for the show said: "The X Factor is open to everybody to apply and we regularly welcome back contestants who want to audition again."

"People are saying it's the coolest Children In Need record ever. That sounds kind of nice."

'Originally people thought Steve had his eye on Cheryl Cole but he once dated her Girls Aloud bandmate Sarah Harding, so neither of them would even go there.'

Steve as something of a lothario in the past has enjoyed a reputation, many famous historical figures, including Hollywood stars Pamela Anderson and Hayden Panettiere.

The X Factor source added: 'Steve has plenty of eye candy on-set but Nicole is definitely the object of some of his finest lines.'

Producers are said "hundreds of contestants' two way mirror, cosmetics and fragrance through the room to get shot footage of rehearsals, according to a report in The Sun.

A show source told The Sun: "It has been really funny for the crew watching people slipping stuff into handbags. It's often the people you would least expect - the quieter folk. They seem to forget they're being filmed, although they've all been warned there are cameras behind the mirrors.

"The problem is, the scenes could play a part in the public vote when the live rounds come round. It looks like the footage will be left out but it might still end up on the spin-off show 'The Xtra Factor'."

After this year, 'The X Factor' turns back to TV3 and UTV.
